Governor Alfred Mutua lost his seat in an appealed judgement, the county is left with no Governor. The Machakos MCAs passed a vote on Tuesday declaring the Governors sit as vacant following a motion by Ekalakala ward Representative Stephen Mwanthi seeking to oust the county chief and seeking to pave way for the county assembly speaker Florence Mwangangi to assure executive powers in an acting capacity.

Mr Mwanthi said ” The house has not yet received any sort of information of report that Mutua has appealed anywhere”, invoicing article 182 section 4 of the constitution, the MCA say that the assembly has not been served with any orders or notice of appeal to the supreme court but the Assembly boss has filed a notice of motion to challenge the decision of the court of appeal. Mr Mwanthi added “The Speaker should take up the office of the Governor until further notice or till the elections are done as ruled.

The Appellate court on friday late week said the county boss was not validly elected and voiled the results by IEBC. This followed and appeal filed by Wipers Wavinya Ndeti to challenge high court’s verdict which said was duly elected in August 2017.
MCAs allied to Governor Alfred Mutua had a heated debate at the assembly led by Deputy leader of minority and MCA Brian kasilla fiercely opposed the motion saying it was not procedural and the Governor will continue to be the Governor until the the supreme court rules otherwise.
