Court of Appeal on Friday morning overturned a High Court judgement that was meant to nullify Embakasi East Member of Parliament Babu Owino’s election.
The three court of appeal judges Justices Mohammed Warsame, Daniel Musinga and Kathurima M’Inoti ruled that the nullification of the results on account of recount and scrutiny was not founded in law.
In March high court Judge Sergon had nullified Mr Owino’s win following a petition filed by Jubilee’s Francis Mureithi.Where Mr Mureithi had accused Mr Owino of electoral misconduct.

Addressing the media after the ruling expressing his joy Babu Owino also known as Paul Ongili extended an olive branch to his opponents inviting them to come and help him serve the people of Embakasi.
“I would tell my opponents to wake up and move on. I also invite them to come and help me serve the people of Embakasi There is a time to lead and a time to be led…my opponents should respect those in power now so that when their time comes they can be respected too”said Babu Owino
Babu Owino assured his constituency residents that they had elected an intelligent and competent leader who was going serve their interests.
” I want to let the people of Embakasi East know they elected an intelligent and competent leader who will serve their interests”added Babu Owino
At the same time, the court dismissed a case filed against Kibwezi East MP Jessicah Mbalu
